Im Bereich des öffentlichen Wirtschaftsrechts werden in den kommenden Jahren besonders umweltrechtliche Fragestellungen im Vordergrund stehen. Sie gewinnen für Unternehmen in jeder Phase der Betriebsführung, aber auch im Bau- und Planungsrecht zunehmend an Bedeutung. In den Industrieländern ist dies auf ein steigendes Umweltbewusstsein, das Verlangen des Kapitalmarktes nach umweltgerechtem unternehmerischen Handeln sowie der Konfliktträchtigkeit des engen Nebeneinanders von Industrie und schutzbedürftigen Nutzungen zurückzuführen. Der Klimawandel fordert zudem radikale Änderungen beim Verbrauch fossiler Brennstoffe, während gleichzeitig die Akzeptanz als kritisch empfundener Technologien (etwa Atomkraft, CCS) sinkt. Es gilt landwirtschaftliche Flächen für die Nahrungsmittelproduktion einer wachsenden Weltbevölkerung und für die Produktion nachwachsender Rohstoffe zu erhalten. Die Europäische Kommission strebt daher den Umbau der europäischen Volkswirtschaften in sog. „low carbon economies" an.
Diese Entwicklungen bergen einerseits erhebliche Risiken für die betroffenen Gesellschaften und eine Reihe von Unternehmen, die auf die Erzeugung und Nutzung fossiler Energieträger ausgerichtet oder angewiesen sind (so die Mineralölwirtschaft, der Luftverkehr, Automobilhersteller). Andererseits eröffnen sich erhebliche Chancen für solche Unternehmen, die umweltschützende Produkte und Dienstleistungen im weitesten Sinne anbieten. Dies betrifft vor allem den Bau energieeffizienter Maschinen und Anlagen sowie die Herstellung von Anlagen zur Erzeugung erneuerbarer Energien, ferner die Immobilienwirtschaft, soweit sie den Energiebedarf der Immobilien drastisch senkt und durch erneuerbare Energien ersetzt. Profitieren können auch Kraftwerkshersteller, die Kraft-Wärme-Kopplung anbieten und der Massentransport auf der Schiene im Nah- und Fernverkehr.
