The implementation of construction and infrastructure projects is subject to a large number of complex legal requirements that need to be observed both when applying for approval and when carrying out a project.

To offer a seamless service we have teams in Europe as well as in Asia, led by partners with many years of experience on both continents. That way we can immediately answer questions concerning investment decisions in Europe and Asia and provide our clients with an accurate assessment of the particularities of their investment, no matter where they are located.

Especially with our offices in Singapore and Shanghai we are present at two important business centers in Asia. Our lawyers have worked in the industry or government branches before joining us, combining legal skills with first hand technical and commercial experience. We advise clients on a wide range of projects and disputes related to real estate, such as acquisition and development of real estate, drafting and negotiation of construction, lease and service contracts and development agreements, and public procurement law. If you are launching or operating a real estate fund or setting up a real estate related joint venture, our on-site fund and corporate experts can provide you with country-specific support. This cross-country approach allows us to guide you through regulatory, debt financing, tax, planning, construction and management issues in addition to our traditional real estate portfolio and property management work.

Our service of advice

  • Conducting due diligence investigations on real property and land-use rights including environmental law requirements
  • Advising on the acquisition and transfer of land use rights and real property in China, drafting and negotiating the respective real estate related contracts, including loan documentation
  • Advising drafting and negotiating all kinds of lease contracts, including inter-company lease contracts or sale-and-lease-back agreements, and assisting in obtaining the relevant registrations
  • Advising and negotiating with relevant authorities on construction planning and building law during the building permit procedure, and assisting in obtaining other necessary government permits
  • Advising on various construction projects in China, including EPC/Turnkey projects, drafting and negotiating the construction contracts with general contractors / subcontractors, local design institutes and project management companies including the FIDIC Suite Construction Contracts
  • Handling the legal aspects of bidding procedures
  • Claim management in construction project disputes including out-of-court settlements and arbitration
