On 5 November 2025, Klinikum Friedrichshafen GmbH filed an application to open insolvency proceedings under self-administration. This was prompted by the threat of insolvency resulting from the suspension and reduction of subsidies for the hospital’s operations. By orders dated 1 February 2026, Ravensburg Local Court opened the insolvency proceedings. Dr Rainer Eckert, founding partner of Eckert Rechtsanwälte Steuerberater Partnerschaftsgesellschaft mbB, was appointed as the insolvency administrator. A creditors’ committee was also established.
Luther advised the self-governing body, working with an interdisciplinary team, particularly in the areas of M&A and company law, hospital and medical law, insolvency and employment law, supplementary pension schemes, state aid and merger control law, public procurement law, data protection law and property law.
“The transaction presented significant challenges in terms of the interplay between insolvency law, M&A, hospital law and regulatory issues. We are therefore all the more pleased that, together with all parties involved, we were able to implement a solution that ensures the business can continue,” says Dr Hendrik Sehy, the partner leading the project at Luther.
