Katharina Stefanie Franke

Katharina Franke positions herself as a strategic partner, specialising in providing comprehensive advice and support to both contracting authorities and bidders in EU procurement procedures, national invitations to tender and structured bidding procedures.

She regularly represents the interests of contracting authorities in her role as an external procurement office and legal project manager in complex procedures. Katharina Franke contributes her expertise to the preparation of tender documents, but also reviews requests to participate and tenders with the utmost attention to detail. Her ability to efficiently organise and conduct bidder presentations and negotiation meetings underlines her competence as a reliable advisor.

Public Procurement Law

Over the course of her academic and professional career, Katharina Franke has developed into an expert in the field of public procurement law. Her university education laid a sound foundation for this specialisation, as she focused on economic administration, environmental law and infrastructure planning, an area that also included the multifaceted field of privatisation and public procurement law.

During her legal training, in particular whilst working at the Ministry of Innovation, Science and Research of the German state of North Rhine-Westphalia, Katharina Franke deepened her knowledge of public procurement law. This experience enabled her to translate legal theories into practice and gave her valuable insights into state regulation, procurement and financing mechanisms. In addition, she also improved her knowledge and skills by working for one of the leading international consulting and audit firms in Germany, where she gained significant insights into international business structures and legal practices. This part of her legal training helped her develop a deeper understanding of the interplay between national and international law.

Since being admitted to the German Bar in 2018, Katharina Franke has not only applied her knowledge of public procurement law in practice, but has also consistently expanded and refined it.

• Ongoing public procurement law advice on large-scale projects (in particular in the planning and construction sectors and in the field of information technology) for a large number of contracting authorities, including ministries, police authorities, government agencies, municipalities, university hospitals, universities and student welfare organisations, as well as for companies
• RAG Aktiengesellschaft – ongoing advice in connection with large-scale EU-wide sectoral procurement procedures, for example, shaft conversion measures (around EUR 120 million), tunnel project (around EUR 200 million), treatment plant for mine water management (around EUR 45 million)
• International chemicals company – advice on an investment project regarding electrolysis of water in the three-digit million euro range using public funding (IPCEI project)
• International glass manufacturer – advice on an investment project regarding decarbonisation in the three-digit million euro range using public funding (CEEAG project)
• Bidder representation – advice to an IT service provider on its participation in an EU-wide invitation to tender for the development of telemedicine in Bavaria, double-digit million euro range
• Town of Herne – advice on EU state aid and public procurement law aspects of large projects, among other things
