Areas of practice

Jutta Wittler’s practice is concentrated on providing legal counsel during the construction process, as well as on litigation and (inter)national arbitration. She is one of the co-editors of the handbooks “Fachanwaltswissen für die Praxis” (Practical Knowledge for Specialist Lawyers), published by C. Heymanns Verlag, Cologne 2006, and “Entwickeln/Planen/Bauen” (Developing/Planning/Building), published by Werner Verlag, 2010. Jutta Wittler was a co-author of the NJW Essay on private construction law (BGB and VOB/B) from 2010 to 2021. Jutta Wittler studied law in Würzburg, Germany and was a trainee at the Higher Regional Court, Bamberg, Germany, which also included a secondment to New York. She has provided legal advice in matters pertaining to construction and architectural law since 1990. She joined Luther’s predecessor firm in 2000.

  • Advising Provinzial Versicherung AG on the compromise with the City of Cologne concerning insurance coverage in connection with the collapse of the Historic Municipal Archive and on the steps subsequently taken in preparation for recourse
  • Advising PHILIP MORRIS Research Laboratories GmbH on the construction of a new laboratory, office and supply building in Cologne (tendering procedure for architects, chief planner contract, construction contracts according to the Rules for the Award and Contents of Construction Contracts, Part B: General Contract Terms for Carrying Out Construction Work (VOB/B), questions arising during the construction process) Advising and representing a Dusseldorf bank in the finalisation of a construction project regarding a new building with respect to disagreement about several matters including the fees payable under the Code of Architects' and Engineers' Fees 1996 (HOAI 1996), the extension of the construction period, and excess payments
  • Acting as arbitrator and co-arbitrator in various national and international arbitration proceedings (German Institution of Arbitration (DIS), Conciliation and Arbitration Rules for Construction Disputes (SOBau) and Arbitration Rules for the Building Industry (SGOBau)) concerning a Berlin embassy building, and pricing disputes and structural defects in connection with the construction of buildings and plants (offshore testfield alpha ventus and offshore windfarm project North Sea East based on FIDIC contracts)
