Municipalisation: Luther advises Krankenhaus Jülich on transfer to public law ownership

Jülich, 30.08.2023 – As part of the wave of insolvencies in the hospital market, Luther Rechtsanwaltsgesellschaft has once again successfully assisted Krankenhaus Jülich GmbH, a private hospital company, in transferring the hospital into public ownership and ending the protective shield proceedings under insolvency law.

Background

The hospital in Jülich filed an application for protective shield proceedings in self-administration in September 2022. In the course of the insolvency plan, the city of Jülich took over all shares in the previously church-run hospital company from the previous sole shareholder, so that the company is now publicly owned and the hospital location in Jülich is secured.

The Luther team, which specialises in hospital transactions, supported the self-administration in setting the course for the successful communalisation of the hospital in the shortest possible time. In this project, it was necessary to involve political committees and the municipal supervisory authority as well as to ensure that the hospital remained a non-profit organisation as part of the public welfare system. After the creditors' meeting declared the necessary approval of the insolvency plan and the future financing of the company is secured, the hospital will now be able to maintain medical care in the region.
