On May 5, 2020, in the wake of the Court of Justice of the European Union's Achmea judgment, 23 of the current 27 European Union Member States signed an agreement for the termination of bilateral investment treaties between the Member States of the European Union. This Agreement affects some 130 intra-EU treaties and raises many novel questions for companies and individuals who have made investments in the European Union or through European Union investment vehicles. What proactive measures can investors take to protect themselves and their investments in the absence of intra-EU treaties? What are investors' dispute resolution options? How can investors take advantage of sunset clauses in intra-EU treaties? This quick fire panel will address these questions, among others, and offer some insight into the anticipated impact of recent developments in dispute resolution in Europe. Following the panel, participants and audience members will continue the discussion and have an opportunity to network in virtual breakout rooms.
