The deep seabed beyond national jurisdiction of States covers three-quarters of the bottom of our oceans. Known to international lawyers as ‘the Area’, this vast expanse of sediment is home to an abundance of minerals, in particular highly prized rare earths and metals. The fast pace of technological progress raises the prospect of commercial mineral exploitation in the not too distant future. Investors seeking to extract deep seabed minerals will inevitably have to tackle a host of untested legal conundrums, including before courts and tribunals.

Marco Benatar’s presentation will address the role of the Seabed Disputes Chamber of the ITLOS with respect to investments in the Area. Topics will include the jurisdiction of the Chamber, its relationship with commercial arbitration and the applicable law in disputes involving contractors.
