In May 2019, the Personal Data Protection Act ("PDPA") was enacted. This is Thailand's first consolidated data protection law, aiming to guarantee protection for individuals and their personal data, and imposing similar obligations on businesses when collecting, using, and disclosing personal data. Many provisions of the PDPA are similar to the EU General Data Protection Regulation, but Thailand has also adapted some unique concepts to be observed, which we will explore and explain in detail. Initially, the PDPA was scheduled to come into force in 2020. Due to the Covid-19 pandemic, this date was postponed twice already, with the tentative new date now 1 June 2022.
