What should employers bear in mind and avoid when terminating an employment contract?
Quite often employers precipitously decide to terminate an employment contract that, consequently, triggers irregularities both in terms of substance and form.
Prior to dismissing an employee, the employer should clearly analyze the specific situation at hand and reply to the following questions: Is the employee protected by a specific situation or status, such as work incapacity or being a staff representative? Is he still undergoing a trial period? Should a preliminary interview take place before dismissal?
